GENERAL
All terms and conditions/or any transactions occurring online at www.artista.ca or by phone are subject to the laws of Canada. Artista Design and Print Inc. is not responsible for the delay and/or damages resulting from Machinery Breakdown, Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo. The tools available on www.artista.ca for creating documents are the property of Artista Design and Print Inc. The Buyer's order shall be deemed an acceptance of the Seller's terms and conditions. The terms and conditions shall in all respects be governed by Canadian law.
PROOFS AND REVIEWING ORDER IS YOUR RESPONSIBILITY
Our Site allows its users and customers to create, personalize, and review their final order before final submission. Some projects/artwork/orders require further assistance by one of our professional graphic designers or customer service representatives in preparing files for final production. Changes made require customer approval before printing and may involve extra charges. We encourage our customers to review their proofs and orders carefully for accuracy. We recommend reviewing fonts, text placement near the cutline, and using two different blacks, among other considerations. If you're unsure of anything at any time, please do not hesitate to contact us.
USE OF WEBSITE AND DESIGN TOOLS
Our design software and tools on our Site are available to all users of the Site. Any artwork/design, such as a sign, graphic, or logo, created using our Site tools does not grant a customer any rights or claims through this Website that enable the creation of the artwork/design. These artwork/design elements are the property of Artista Design and Print Inc. (or the licensor if applicable). They will freely remain available to other Artista Design and Print Inc. customers. Your use of the Site Content provided on this Website and/or the creation of products or materials using such Site Content does not create joint authorship, joint ownership, works made for hire, or any other interest of any kind with Artista Design and Print Inc.
SHIPPING
Shipping terms are Free On Board (F.O.B.). Artista Design and Print Inc. will arrange shipping with the carrier on behalf of the buyer. Artista Design and Print Inc. is not responsible for delivery delays, loss, or damage to the order while it is with the shipping carrier.
RESERVATIONS
Artista Design and Print Inc. reserves the right to reject any order at any time without recourse. Orders are subject to acceptance.
CANCELLATIONS, REFUNDS, WARRANTIES AND RETURNS
Due to the nature of the product, returns are not accepted once the order has been processed and shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. We will replace only those orders that were processed incorrectly by Artista Design and Print Inc. The replacement order will be processed only after receipt of the returned merchandise. We will not replace the order if it is determined that the order was misused or mishandled by the buyer, or part of the order was used by the buyer, and part of the order is being returned.
Artista Design and Print Inc. makes no explicit warranty and neither implies nor accepts any responsibility other than the possible replacement of the products purchased by the Buyer.
Artista Design and Print Inc. may, but does not guarantee, the replacement of the defective product, or credit the amount of the purchase price. Artista Design and Print Inc. and affiliated companies will not refund any money for the orders that were shipped or were cancelled after the order was being processed.
CREDIT CARD
If the Buyer's credit card is declined, Artista Design and Print Inc. will not process the Buyer’s order. If the order is shipped and should the Buyer's account become delinquent, Buyer agrees to pay a monthly finance charge of 2% (annual percentage rate of 24%) on the unpaid balance. If an account goes beyond the payment term's due date, unless specific arrangements are made, future purchases will require advance payment. In the event that Artista Design and Print Inc. must commence legal action to enforce any terms of this agreement, the Buyer agrees to pay reasonable legal fees and costs.
ACCEPTANCE OF TERMS OF USAGE
These Terms of Usage govern your access and use of this Site. By accessing or using this Site you agree to be bound by these Terms of Usage and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Use.Artista Design and Print Inc. reserves the right to make changes to this Site and to these Terms of Usage at any time without prior notice. LIMITATION OF LIABILITY
Artista Design and Print Inc. will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages arising out of or resulting from the performance or nonperformance of any obligations by anyone. Artista Design and Print Inc. shall not be liable for any financial losses, costs, expenses, damages, and/or other economic damages. The Buyer agrees that the Buyer will not hold Artista Design and Print Inc. responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against Artista Design and Print Inc. on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person's right to privacy or other personal rights.
